Mr. Atul Sharma, Managing Partner of Link Legal India Law Services, and Mr. Santosh Pai, Partner and Head of China Desk, Link Legal recently visited CIETAC, a statutory arbitral institution, at Beijing and had an interactive session with Mr. Wang Chengjie, Vice Chairman and Secretary General.
Link Legal, a full-service law firm in India, is the first Indian firm to establish a dedicated China Desk and since 2010 has provided services to more than 100 Chinese companies in successfully investing in the Indian market. As part of the interactive session, Link Legal shared the legal framework on the Indian arbitration regime, Chinese companies operating in India and the selection trend of dispute resolution methods between Chinese and Indian companies.
Mr. Wang gave a brief history of CIETAC. Ad-hoc arbitrations are not permitted in China and CIETAC occupies the position of being one of the most recognised arbitration institutions in China. It follows Chinese Arbitral Law which is closely modelled on the UNCITRAL Rules. India, being one of the countries under the Chinese ‘One Belt One Road’ Initiative’, is an important target for investment.
